You could have your agent approach the seller to ask for a "pocket listing". That means that the agent is asking to get paid a commission if he/she brings the one buyer they have interested in the property. That way it isn't a long term listing which they are probably weary of since their previous one expired without a sale.
I have arranged for my realtor to receive a flat fee for every expired listing that she provides that results in a closed deal.
