Bypassing the realtor to get to the seller

My question is this. If I find a house I am interested in and want to put it under contract and it is listed through an agent, how do I get to the owner myself? Ex: I find a two bedroom, one bathroom single family home that is in foreclosure and the listed price is $80,000 how do I bypass the realtor it is listed through or do I have to speak with the seller's realtor first to make an offer?

The right way

Hello,
ErickD contact the REA and ask them to represent you,More COMM. for them!
Not to sure on telling them about being REI,Then again...They will figure it out by your offer!

Open Brokerage Agreement

Only if the seller has an open brokerage agreement with the agent or broker selling their house will you be able to go around either REA or REB to talk directly to Seller. If not you have to speak to the REA representing the seller. But don't tell the REA what you may be able to pay for house it's their fiduciary duty to tell any information you tell them to convey to the owner. Go take a look at the place to determine what repairs it may need and then go do your homework; then go back and present your offer to the seller's agent & back it with the information you have at hand.

New Investor

I just finished reading "Profit form Real Estate Right Now". There are a couple of abandoned houses in my neighborhood. I check my county's property appraisers page by using their address. A bank in another state looks like owns these properties. Is is possible for me to send a letter or card to these banks and offer them my services as a Marketing Consultant to sell these houses in an auction? I understand that I need an attorney if I sign an agreement with these banks, right? Any suggestions?

Set-back

like I mention in my previous post is their Fiduciary Duties to the Seller. Seller's agent can/will transition to a neutral position when you Buyer come into the picture (unrepresented) and ask for either that REA or another REA in same firm to represent you in putting in an offer. The catch is they still have fiduciary duties they have to fulfill to the Seller. So that's why I said don't tell them what you may be able to pay on the house or what amt you're pre approved for for a loan. They're under obligation to go back & tell the seller whatever information you told them. When a REB/REA gets an Exclusive Brokerage Listing between them and the Seller; every agent in that firm is now under same obligation of fulfilling whatever Fiduciary duties as the first REA had that took the listing. In other words, no agent in the firm can sell the Owner/Seller short or else the Broker would be liable.

You may approach the selller

You may approach the seller and converse, but the seller will refer you to the listing agent due to the contract they have with them. As long as the contract is binding the seller is better off not transacting business with the buyer.

Can the seller withdraw the listing(Take it off the market) with the REA if they want to work with me instead?

Withdrawing realitors contract

They can if the realitor wants to give there clieant a release.But agin be very careful what is ritten in that release.realitors are in the game to make money.

I would guess that you found out about the property from marketing done by the listing agent. If this is the case, the listing agent is going to expect to be paid for attracting a buyer.

I found out about it

I found out about it through my We Buy Houses ads. The Lady had already listed it but called me afterwards.

She has five houses. She put three up for sale with the listing agent. After talking to her, she may want to sell the other two as well. Four of the houses are executive rentals and in really good shape. The two she didn't list are rented out.
It sounds like she wants full price for the properties. She is asking about 20k over the totalviewrealestate estimated price for each house. Not sure there is much I can do to help her. She has the four rentals on one commercial loan in which she has missed one payment.

If the seller found her own buyer, she may be able to work a reduced commission with her listing agent. I give significant reductions in my commission if the seller finds their own buyer. The listing agent has incurred some costs in marketing that they probably would want covered. The seller may also want the agent to represent them in the sale process.
